New York Labor Law Section 240
New York State Labor Law Section 240 is a labor law that protects workers from height-related injuries such as falls from ladders, scaffolds, roofs, or falling objects. New York Labor Law Section 240 requires contractors to provide mandatory safety measures to prevent height-related accidents. If a company does not provide these safety measures, the owners and company are responsible for height-related injuries.
Additionally, Labor Law Section 241 and Industrial Rule 23 provide protections for construction workers by making owners and contractors responsible for injuries when they do not put the needed safety standards in place.
The Construction Accident Law Defined
Imagine working at night, in dark conditions and you slip and fall on an oil-slicked concrete deck. Rule 23 aims to protect injured construction workers:
“Employers shall not suffer or permit any employee to use a floor, passageway, walkway, scaffold, platform or other elevated working surface which is in a slippery condition. Ice, snow, water, grease and any other foreign substance which may cause slippery footing shall be removed, sanded or covered to provide safe footing.”
For example, in the case of Potenzo v City of New York, the court ruled that the owners’ and contractors’ failure to clean an oily and slippery workspace made them liable for the workers’ injuries when they slipped and fell.
